TERMS AND CONDITIONS

§ 1 GENERAL

§ 1.1 Hooked on Lofoten

These Terms & Conditions apply to bookings and experiences provided by Hooked on Lofoten AS.

We want our booking conditions to be clear and fair. Please read them before booking, especially the sections regarding cancellations, weather, safety and changes to an experience.

Hooked on Lofoten AS is a Norwegian activity and experience company based in Lofoten, offering guided outdoor experiences, fishing, sightseeing, private tours, culinary experiences and tailor-made journeys.

Registered company details:

§ 1.2 Your Agreement With Us

When you make a booking, you enter into an agreement with Hooked on Lofoten AS.

The agreement consists of:

  • The experience or product description

  • Your booking confirmation

  • Any specific written arrangements agreed with us

  • These Terms & Conditions

  • Applicable Norwegian law

The person making the booking must be at least 18 years old and is responsible for ensuring that all participants included in the booking are aware of the relevant booking information and these Terms & Conditions.

If specific terms stated in your booking confirmation differ from these general Terms & Conditions, the specific terms confirmed for your booking will normally apply, subject to mandatory Norwegian law.

§ 1.3 Applicable Law

All services are provided in accordance with Norwegian law. Where relevant, provisions of the Norwegian Contracts Act (Avtaleloven), the Marketing Control Act, and other applicable legislation apply.

§ 1.4 Use of Third-Party Providers

Some experiences may include services provided in cooperation with carefully selected third parties, such as restaurants, chefs, transport providers, accommodation providers, activity partners or boat operators.

Where these services form part of an experience purchased directly from Hooked on Lofoten, we remain responsible for our obligations to the customer to the extent required by the agreement and applicable Norwegian law.

Where a customer purchases a separate service directly from a third-party provider, that provider’s own terms and conditions may apply to that separate purchase.

§ 1.5 Privacy

By booking with us, you consent to the collection and processing of necessary personal data for the purpose of delivering the service. Personal data may be shared with relevant subcontractors where required. For more information, please refer to our Privacy Policy.

§ 2 OUR SERVICES

Hooked on Lofoten offers various outdoor experiences, including but not limited to:

• Fishing tours (land-based or boat-based)
• Hiking tours
• Private customized tours
• Sightseeing tours
• Culinary and combination experiences

The content, duration, group size, and structure of each tour vary and are described individually on the relevant product page and booking confirmation.

§ 3 BOOKING AND PAYMENT

§ 3.1 Booking & Payment

A booking is confirmed when payment has been received or when we have otherwise confirmed the reservation in writing.

All prices are stated in Norwegian kroner (NOK) unless otherwise specified.

The customer is responsible for providing correct contact information, participant information and any other information requested during the booking process.

Only services and items specifically stated as included in the experience description, offer or booking confirmation are included in the price.

Any additional services requested during or after booking may result in an additional charge.

§ 3.2 Bookings Made Through Partners & Booking Platforms

If you book through a third-party booking platform, travel agency, hotel, tour operator or other reseller, additional or different booking, payment and cancellation conditions may apply.

The conditions presented and accepted when making that booking will apply where relevant.

Questions regarding payments or refunds for bookings paid directly to a third party may need to be handled through the company or platform where the booking was made.

§ 3.3 Shared Tours & Minimum Participation

Some of our shared experiences require a minimum of two paying participants to operate.

If the minimum number has not been reached, we may contact you before the experience to offer:

  • An alternative date or departure

  • Another suitable experience

  • The option to pay the minimum required price to guarantee the departure

  • A full refund if the experience is cancelled by us

Any minimum participation requirement specific to your experience will be stated in the product information or communicated before departure.

§ 3.4 Private & Tailor-Made Experiences

Our private tours and Signature Experiences are designed with flexibility in mind.

An itinerary, route or programme may be created before your arrival, but this should be considered the planned framework for the experience rather than a guarantee that every location or activity will be completed exactly as originally described.

Weather, sea conditions, accessibility, opening hours, wildlife, local conditions, safety considerations and other circumstances can affect what is possible on the day.

Where necessary, we may adjust the route, timing, order of activities, transportation, location or individual elements of an experience.

Whenever possible, we will make these decisions together with you and aim to preserve the overall quality and character of the experience.

Tailor-made experiences may also have booking, deposit or cancellation conditions specific to the reservation. Any such conditions will be communicated before the booking is confirmed.

§ 3.5 Meeting Times, Pickup & Late Arrival

Customers are responsible for arriving at the stated meeting point or being ready at the agreed pickup location at the confirmed time.

We recommend arriving 10–15 minutes before departure unless otherwise stated.

If you are late, please contact us as soon as possible.

Because many experiences depend on boats, other guests, restaurant reservations, daylight, tides or other scheduled elements, we cannot guarantee that a tour can wait for late participants.

Missing an experience because of late arrival is considered a no-show and is not refundable.

Hooked on Lofoten is not responsible for missed experiences caused by delayed flights, ferries, cruise ships, buses, rental cars or other transportation outside our control.

We strongly recommend allowing sufficient time between your arrival in Lofoten and the start of your experience.

§ 4 WHAT IS INCLUDED

What is included in each tour is explicitly stated in the individual tour description and booking confirmation.

Group sizes vary depending on the specific activity and operational setup. Maximum group size is determined per tour and may differ between experiences.

Only services explicitly listed as included in the tour description or booking confirmation are included in the price.

Unless otherwise stated, customers are responsible for:

• Transportation to and from the meeting point
• Travel insurance and personal insurance
• Personal clothing and suitable footwear
• Meals or beverages not specifically listed as included

§ 5 USTOMER RESPONSIBILITIES

§ 5.1 Health, Fitness & Participation

Customers are responsible for choosing an experience suitable for their health, fitness and abilities.

Some experiences may involve:

  • Walking or hiking on uneven terrain

  • Snow and ice

  • Steep or slippery surfaces

  • Boat travel and movement at sea

  • Cold weather

  • Cold water

  • Remote locations

  • Fishing equipment and hooks

  • Knives or other tools

  • Open fire

  • Sauna and cold-water bathing

Any medical condition, physical limitation, allergy or other circumstance that could affect safe participation should be communicated to us before the experience.

If you are uncertain whether an activity is suitable for you, please contact us before booking.

We reserve the right to refuse or stop participation where a guide or skipper reasonably believes that continuing could create a safety risk for the participant, the group or our staff.

§ 5.2 Following Instructions

Participants must follow all safety instructions given by guides or staff. Failure to comply may result in removal from the activity without refund.

§ 5.3 Travel Insurance

We strongly recommend that all guests have appropriate travel insurance.

Depending on your trip, this should include cover for cancellation, illness, accidents, medical treatment, evacuation, travel disruption and personal belongings.

Hooked on Lofoten does not provide personal travel insurance for participants.

§ 5.4 Children

Children must be accompanied by a responsible adult unless specifically agreed otherwise.

Age limits and suitability vary between experiences.

Parents or guardians are responsible for determining whether an experience is suitable for the child and for ensuring that the child follows instructions from our guides and staff.

Please contact us before booking if you are uncertain whether a particular experience is suitable for your child.

§ 5.5 Clothing & Personal Equipment

Customers are responsible for bringing clothing and footwear appropriate for the activity and the conditions unless specific equipment is stated as included.

Weather in Lofoten can change rapidly, and warm, windproof and waterproof clothing may be necessary even during summer.

Any equipment supplied by Hooked on Lofoten must be used according to instructions.

We reserve the right to refuse participation where clothing or footwear creates a significant safety concern and no reasonable alternative is available.

§ 5.6 Food, Allergies & Dietary Requirements

Some of our experiences include meals, snacks, refreshments or food prepared from the day’s catch.

Customers must inform us in advance about allergies, intolerances or important dietary requirements.

We will make reasonable efforts to accommodate dietary requirements when possible, but we cannot guarantee that every requirement can be accommodated for every experience, particularly at remote locations or where food is prepared by third-party restaurants or chefs.

Customers with severe or life-threatening allergies should contact us before booking so that we can determine whether the experience can be provided safely.

§ 5.7 Personal Belongings

Customers are responsible for their personal belongings during an experience.

Please take particular care with phones, cameras, glasses and other valuables during boat trips, hiking, fishing and other outdoor activities.

Hooked on Lofoten is not responsible for loss or damage that is not caused by circumstances for which we are legally responsible.

§ 6 WEATHER, SAFETY AND CHANGES

§ 6.1 Weather, Sea Conditions & Safety

Weather in Lofoten can change quickly.

Safety always comes first.

Our guides and skippers have the right to change, shorten, relocate, postpone or cancel an activity when they consider this necessary because of weather, sea conditions, snow conditions, visibility, safety concerns or other circumstances affecting safe operation.

This may include changing:

  • A hiking route or destination

  • A fishing location

  • A boat route

  • A sightseeing itinerary

  • The order or timing of stops

  • A dining or outdoor location

  • A planned sauna location

  • Other outdoor elements of an experience

A change of route or location due to conditions does not automatically constitute cancellation of the experience if a reasonable alternative can be provided.

Participants must follow instructions given by guides, skippers and other responsible staff.

§ 6.2 Natural Phenomena, Wildlife & Fishing

Nature is an important part of what we do, but nature cannot be controlled.

We therefore cannot guarantee:

  • Northern Lights

  • Midnight Sun or specific light conditions

  • Wildlife or sea eagle sightings

  • Particular weather or visibility

  • Snow conditions

  • Catching fish

  • A particular fish species, size or quantity

  • Crab or other marine catches unless specifically confirmed

For fishing experiences, our guides and skippers use their local knowledge to select suitable fishing areas based on season, weather, sea conditions and recent fishing activity.

Not catching fish or not seeing a particular natural phenomenon does not in itself entitle the customer to a refund.

§ 7 CANCELLATIONS AND REFUNDS

§ 7.1 Customer Cancellation

Unless different cancellation conditions were clearly stated and accepted for your specific booking, the following cancellation policy applies:

More than 14 days before the experience

Full refund.

Between 14 days and 72 hours before the experience

50% of the total booking price will be charged.

Less than 72 hours before the experience

No refund.

No-show

No refund.

Cancellation must be communicated to us in writing.

The cancellation time is calculated from the scheduled starting time of the experience.

Refunds are normally returned to the original payment method.

Bookings for leisure activities provided on a specific date or during a specific period are generally exempt from the standard statutory right of withdrawal applicable to many online purchases. Your cancellation rights are therefore governed by the cancellation conditions applicable to your booking and mandatory Norwegian law.

§ 7.2 Cancellation or Significant Changes by Hooked on Lofoten

We may cancel an experience if it cannot be operated safely or reasonably due to weather, sea conditions, safety concerns, insufficient participation, unexpected operational circumstances or other circumstances outside our reasonable control.

If we cancel the entire experience before it begins and cannot provide a reasonable alternative, you will be offered:

  • Rescheduling to another available date, or

  • A refund of the amount paid for the cancelled experience

If only part of a multi-element or tailor-made experience cannot be delivered, we will first try to provide a suitable alternative.

Where a significant included element cannot be delivered or reasonably replaced, we will assess an appropriate solution based on the circumstances and applicable law.

§ 8 Outdoor Activities & Inherent Risk

Outdoor experiences involve risks that cannot be completely eliminated.

Depending on the activity, these may include changing weather, uneven terrain, slippery surfaces, cold temperatures, movement at sea, cold-water exposure, remote locations and the use of outdoor or fishing equipment.

Hooked on Lofoten plans and operates experiences with safety in mind, but participants must also act responsibly, follow instructions and take reasonable care of themselves and others.

Participation is voluntary, and customers should consider the nature of the activity before booking.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is not permitted under mandatory Norwegian law.

§ 9 RISK ACKNOWLEDGEMENT AND ASSUMPTION OF RISK

Participation in outdoor and adventure activities involves inherent and unavoidable risks.

By booking and participating in any activity organized by Hooked on Lofoten AS, the Customer acknowledges and accepts that such activities may include, but are not limited to:

• Exposure to changing and unpredictable weather conditions
• Travel by boat or vehicle
• Hiking or movement on uneven, slippery, or rugged terrain
• Cold water exposure
• Use of fishing equipment, knives, open fire, or sauna facilities
• Remote locations with limited immediate access to medical assistance

The Customer understands that these risks may result in injury, illness, property damage, or in rare cases, serious harm.

By participating, the Customer confirms that:

• They voluntarily assume all inherent risks associated with the activity
• They understand that outdoor activities cannot be made completely risk-free
• They are physically and mentally capable of participating
• They accept responsibility for their own safety and conduct

Nothing in this section limits liability in cases of gross negligence or willful misconduct where such limitation is prohibited under mandatory Norwegian law.

§ 10 ALCOHOL, DRUGS AND BEHAVIOUR

§ 10.1 Alcohol and Intoxicants

Alcohol may be served or available as part of certain private dining or other experiences where legally permitted.

Participants must consume alcohol responsibly.

Participation in activities requiring safe physical coordination – including operating equipment, active fishing, hiking, boating activities or cold-water bathing – may be restricted if a participant is affected by alcohol or other intoxicating substances.

We reserve the right to refuse or terminate participation where intoxication creates a safety risk.

No refund will be provided where participation is refused or terminated because of unsafe or inappropriate behaviour.

§ 10.2 Responsible Behaviour

Participants are expected to behave responsibly and respectfully toward guides, staff, other participants, local communities, and nature.

Aggressive, reckless, unsafe, or disruptive behaviour will not be tolerated.

Hooked on Lofoten reserves the right to terminate participation if behaviour is considered unsafe or inappropriate. No refund will be provided in such cases.

§ 10.3 Environmental Responsibility

Participants must respect nature and follow Leave No Trace principles. Intentional damage to environment or property may result in liability for damages.

§ 11 DAMAGE TO EQUIPMENT AND PROPERTY

Participants are responsible for the proper use of all equipment provided during the activity, including but not limited to fishing gear, safety equipment, boats, sauna facilities, vehicles, and tools.

Any damage caused by negligence, misuse, or failure to follow instructions may result in financial liability.

Hooked on Lofoten reserves the right to charge participants for repair or replacement costs if equipment or property is damaged due to improper use or reckless behaviour.

Normal wear and tear resulting from appropriate use is not considered damage.

Participants are also liable for any damage caused to third-party property during the activity due to their actions.

§ 12 PHOTOGRAPHY AND MARKETING

Our guides may occasionally take photographs or short videos during an experience.

We will not rely on participation alone as permission to use identifiable images of you for advertising or promotional purposes.

Where we wish to use clearly identifiable photographs or video of guests for marketing, we will ask for appropriate permission.

You are always welcome to tell your guide that you do not wish to be photographed.

Professional photography arranged as part of a private experience may be subject to separate arrangements concerning delivery and use of the photographs.

§ 13 DISPUTES AND JURISDICTION

These Terms & Conditions and agreements with Hooked on Lofoten AS are governed by Norwegian law.

Nothing in these Terms & Conditions limits rights that cannot legally be excluded or restricted under mandatory Norwegian consumer legislation.

Any dispute should first be raised directly with Hooked on Lofoten so that we have an opportunity to resolve the matter together.

If the matter cannot be resolved, customers may use the complaint and dispute-resolution options available under Norwegian law.
